Acceptance

Any stay at Kyah or use of any part of Kyah and/or its facilities and services are subject to these terms and conditions.  

By making a reservation at Kyah and/or accessing the property irrespective of the method or platform by which you access and use the property and/or its facilities and services, you irrevocably agree to and accept these terms and conditions.  The person making the reservation will be deemed to have agreed to and accepted these terms and conditions on behalf of all persons who will staying at Kyah.

 

Restaurant & Bar

Blaq Restaurant & Bar is open as follows:

Breakfast:                  7:00am - 10:00am 7 Days a week

Lunch:                       12:00pm - 3:00pm Saturdays & Sundays

Dinner:                       5:00pm - 9:00pm Wednesdays to Sundays

Drinks & Nibblies:       7.00am - 9.00pm Daily

If you would like to have a meal at Blaq, we do highly recommend booking in advance for lunch and/or dinner to avoid disappointment!

 

Check-In

Check in is at 2pm. Should you wish to arrive earlier, we are more than happy to store your luggage and you are welcome to explore Kyah.  Enjoy a drink or a bite to eat at Blaq and relax in the Greenhouse.  

You will receive your unique, contactless check in details, including room access pin via email once your stay with us is confirmed and payment is processed.

 

Check-Out

Check-out is at 10am.  Departure after that time may incur additional room charge.  Checkout is an automated process and there is no need for you to do anything, except wave goodbye!  We will process any payments or charges on the card provided to us.   

If you were provided any key and/or security card for your room, you must return these at the time of your departure.

 

Cancellation Policy

Our cancellation policy requires any cancellations or amendments be made by 2pm 48 hours prior to arrival. Any cancellations after this time or no-shows will be charged a cancellation fee equivalent to any accommodation cost that falls within the 48 hour period (plus local taxes and credit card surcharge).  All charges will be made to the card provided by you. 

 

Booking Amendments

In the event of travel plans changing, guests will have the liberty to amend their booking dates (subject to the above hotel cancellation policy). Please note by doing this, hotel rates will fluctuate daily and booking dates that are adjusted will absorb the most current rate available on the day of the amendment.

 

Hotel Information

Kyah has made all reasonable efforts to ensure that the information provided is free from error.  Kyah, however, does not warrant the accuracy, adequacy or completeness of information.  Information provided on our website or any other site does not constitute or contain professional or other advice and may contain information that is outdated or incorrect.

 

Photo Id

When you check-in, you may be asked to provide photo id that matches the name of the guest that booked. If you are unable to provide such identification, your reservation may be cancelled, and you may be liable to pay us an amount equal to the full reservation amount plus any other costs incurred by us in connection with your reservation.

 

Payments and Charges

We have automated payments and generally your room charge will be processed 48 hours prior to your arrival date.  

As for any other charges or incidentals, we will require you to provide a valid credit card prior or on check-in.  You agree and authorise us to charge the  card provided, for any other charges associated with your stay such as but not limited to any costs incurred in Blaq, The Pantry or room service charges, mini bar (if any), and also in connection with breakages/damages, excessive cleaning charges (above the normal level of cleaning due to the room being left in an unacceptable state), late check-outs and the reasonable cost of replacing any removed room belongings and amenities.  You also agree and authorise us to charge your card for any costs that may arise in connection to any stolen items or damage(s) caused by you to our facilities and services.

Payments by credit card may incur a transaction fee. The transaction fee will vary based on the charges made to us from our bank.

 

Pricing

All prices are quoted in Australian dollars (unless otherwise specified) per room per night and are inclusive of GST. Prices are subject to availability and can change without notification due to fluctuations in charges and currency. The "from" rates displayed on the website are indicative rates only, are subject to availability & terms and conditions apply. Please select dates and check availability to get the most up to date pricing.

 

Occupancy

You must advise us of any change in the number of persons using the room and agree to pay any additional charges for additional persons not included in the number stated at the time of registration.

 

Minors

Persons under the age of 18 must be accompanied by a responsible adult.

 

Pets

Our pet friendly rooms incur an additional fee of $50.00 AUD.  Pet friendly room requests must be sent to us via email 48 hours prior to check-in.  Feel free to roam around Kyah with your furry friend, but we do kindly ask that you are with your pet at all times and that they be on a leash.   We do not allow pets in internal common areas. It is your responsibility to pick up after your pet.

 

Facilities and Services

While care is taken to ensure that the description of our facilities and services is accurate, these are continually being changed, upgraded, and on occasion taken out of service.  If any feature or facility is essential to you in choosing Kyah, it is your responsibility to confirm with us prior to making your reservation that the feature or facility will be available during your stay.  

While we will do everything possible to ensure that the facilities and services are available and ready for use, during your stay, we cannot guarantee that all facilities will be available and will not be liable for omissions, errors or changes to the facilities and services at Kyah, whether temporary or permanent.

You accept full responsibility for the care and treatment of our facilities and services and are used at your own risk. You agree that you are in a fit and proper condition to use our facilities and services and we do not accept any responsibility for any injury or damage. You agree to release, indemnify and hold harmless Kyah and its team against any claims, actions or proceedings for any injuries caused to you or others while using our facilities and services. 

You agree to return our facilities and services in the same condition that you originally took the facility or service. If our facilities or services are damaged or is not in the same condition prior to use, you will be liable to pay reasonable costs to reinstate the facility or service to its original condition. You acknowledge and consent for us to use anti-theft technology on our facilities and services to limit any theft that may arise.

To participate in or use our facilities and services we may ask you to provide photo id, be over the age of 18 or have parental supervision.

You acknowledge and accept that if we deem that you are using our facilities and services in an unsafe or hazardous manner, we may immediately cease your use or participation.

 

Releases and Indemnity

Any monies or valuables that belong to you, brought to Kyah, remain your responsibility and we are not responsible for their safekeeping.  You agree to release, indemnify and hold harmless Kyah and its team against and from all costs, liabilities, claims, damages, and losses arising out of, caused by, attributable to or resulting from your stay or attendance at Kyah.

 

Guest Courtesy

For the comfort and enjoyment of all our guests, we ask that noise is kept to a minimum so everyone can enjoy a peaceful and relaxing stay.  Non-registered visitors are required to leave all rooms by 11pm each evening.  Any disturbances to other guests or behaviour which we consider may affect guests or our team will not be tolerated and may result in your stay being terminated without refund.  We also ask that this courtesy be extended to our neighbours when entering and exiting the building or car park. We reserve the right to enter any room in the interest of security and/or safety.

 

Smoking Policy

Please be advised that Kyah is a non-smoking venue in all room and balconies.  Smoking is only allowed in designated outdoor areas. Where smoking occurs indoors, a cleaning fee will apply if there is evidence of smoking in the rooms or balconies.

Photography Policy

Any photography of our space for commercial, film or marketing use for another brand or company will need to be approved by us prior to use. We have the right to cancel accommodation and require the immediate cessation of any activity taking place in breach of this condition.

Privacy Policy & Use of Information

You consent and authorise Kyah to collect, use and disclose your personal information for the purposes of administering your booking and providing you with services associated with your booking.  Kyah handles all personal information in accordance with privacy laws.
